SAN FRANCISCO, Dec. 31 (UPI) — A federal appellate court ruled that U.S. technology giant Apple’s diminutive music maker the iPod was not “unsafe or defective.”

A federal appeals court judge on Wednesday essentially pushed the mute button on a class-action lawsuit alleging that Apple’s iPod earbuds are unsafe. Judge David Thompson of the Ninth Circuit Court in San Francisco upheld a ruling by a lower court dismissing a 2006 suit brought by two men who wanted the company to redesign its earbuds and test iPod users’ hearing, in addition to paying damages.

CHICAGO - Two customers who sued Apple Inc. in 2006, alleging that volumes of up to 104 decibels in its iPod music player could cause hearing loss, did not convince a federal judge, who threw the suit out. Nor did they convince a federal appeals court, which yesterday refused to overturn the dismissal.
